Indonesian Biodiesel Tariffs Get Green Light From CIT Judge – Law360

Law360 (December 2, 2020, 4:04 PM EST) — The U.S. Court of International Trade endorsed duties on imports of Indonesian biodiesel on Tuesday after the federal government said a contested variable was never actually part of its tariff formula.

CIT Judge Richard K. Eaton affirmed Commerce’s uncontested redetermination, upon remand from an earlier order, imposing its previously calculated duties on Indonesian biodiesel exports.

“The court finds that Commerce has complied with its instruction … because the department determined that its ad valorem rate for crude palm oil provided for less than adequate remuneration excluded any claimed effects of the 1994 export tariff,” Eaton said.
